1. General Provisions

These Terms and Conditions define the rules for using the website smartgainpl.com and services provided electronically by Smartgainpl Sp. z o.o. with its registered office in Warsaw, ul. Marszalkowska 84/92, 00-514 Warsaw, registered in the KRS under number 0000912345, NIP 5213891072, REGON 387654210. Using the website is equivalent to accepting these Terms and Conditions.

2. Definitions

Terms used in these Terms and Conditions mean: Service Provider — Smartgainpl Sp. z o.o.; User — any natural person using the website; Services — advisory services in personal finance, European grants, tax deductions, and government programs provided electronically; Website — the internet service available at smartgainpl.com; Contact Form — an electronic form enabling the submission of inquiries to the Service Provider.

3. Types and Scope of Services

The Service Provider provides the following services electronically: free preliminary analysis of the User's eligibility for government benefits, European grants, and tax deductions; providing information about available financial support programs; assistance in completing applications for grants and benefits; online consultations in personal finance and tax optimization.

4. Conditions of Website Use

Using the website is free and does not require registration. To use the website, a device with Internet access, a web browser supporting JavaScript and cookies, and an active email address (for using the contact form) are required. The User agrees to use the website in accordance with applicable law, these Terms and Conditions, and good practices.

5. Contact Form

The contact form is used to submit inquiries regarding the Service Provider's services. The User provides their first and last name, email address, and message content in the form. Providing data is voluntary but necessary to receive a response. The Service Provider makes every effort to respond to inquiries within 24 business hours of receiving the message.

6. Liability

The Service Provider is not responsible for financial decisions made by the User based on information published on the website. Content published on the website is informational and does not constitute legal, tax, or investment advice under applicable regulations. The Service Provider does not guarantee achieving a specific outcome in proceedings regarding grants, benefits, or tax deductions.

7. Intellectual Property

All content on the website, including texts, graphics, logos, photographs, and page layout, are the property of the Service Provider or are used under license and are protected under copyright law. Copying, distributing, or using materials from the website for commercial purposes without the written consent of the Service Provider is prohibited.

8. Complaints

The User has the right to file a complaint regarding services provided electronically. Complaints should be sent to: reklamacje@smartgainpl.com or to the Service Provider's registered office address. The complaint should include the User's name, email address, description of the problem, and expected resolution. The Service Provider reviews complaints within 14 business days of receipt.

9. Applicable Law and Dispute Resolution

These Terms and Conditions are governed by Polish law. Any disputes arising from the use of the website or the Service Provider's services shall be resolved by the court competent for the Service Provider's registered office. Before taking the matter to court, a consumer User may use out-of-court dispute resolution methods, including the ODR platform available at https://ec.europa.eu/consumers/odr.

10. Final Provisions

The Service Provider reserves the right to amend these Terms and Conditions. Users will be notified of any changes via the website at least 14 days in advance. Using the website after changes take effect constitutes acceptance thereof. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply, in particular the Civil Code and the Act on Providing Services by Electronic Means.
